Generally speaking, motorcycle riders in Cherry Hill are held to the same traffic laws as other motor vehicle operators. They follow all the same rules of the road, and other motorists need to give motorcycle riders the same respect as they would to other drivers.
It is important for motorcycle riders to follow the traffic laws in Cherry Hill because an individual wants to avoid getting into an accident, especially on a motorcycle. Because even a minor impact can turn into a severe injury when a motorcycle is involved, whether it is a minor fender-bender that normally would have resulted in no injuries, an individual should be careful when riding a motorcycle.
When someone on a motorcycle is involved in a crash, it is going to result in significant injuries because they are likely to be thrown from their bike. Therefore, it is very important to try to follow all the Cherry Hill motorcycle laws so that does not happen.
Determining Liability
The way that traffic laws could impact a motorcycle injury case depends on who was not following the laws. A lawyer could help determine whether the motorcyclist was following Cherry Hill traffic laws, because they might not have a claim against the other party if they were at fault for disregarding the rules of the road.
If the other driver was not following the laws and collided with a motorcyclist as result, thereby causing injuries, they may be held responsible for most or all of the motorcyclist’s damages. They can make an argument that the motorcyclist is at fault for not abiding by the proper motorcycle laws. However, that is not always the case. There are cases where a traffic law was violated, such as not wearing a helmet, but that is not enough to prevent a person from being able to bring a claim against the other driver if they were also deemed at fault.
Because New Jersey is a comparative negligence state, the motorcyclist could share in some of the responsibility. As long as their share does not exceed 50 percent, they are still entitled to some recovery against the other driver. A local lawyer could help ensure that any allegations of liability on the part of the injured motorcyclist are successfully refuted with compelling evidence of the negligent driver’s disregard for traffic laws.
