The holidays are a time for celebration, but they also bring unique challenges – especially here in New Jersey. Snow-covered sidewalks, crowded stores, and festive (but sometimes hazardous) decorations can turn a routine day into a painful disaster. Slip-and-fall accidents are all too common this time of year, and they can leave you with more than just a bruised ego. Injuries from these accidents can disrupt your life during a season that’s already stressful enough.
If you’ve been hurt in a slip-and-fall, it’s important to know what steps to take and how to protect your rights. Here’s what you need to know to stay safe and what to do if the worst happens.
Why Do Slip-and-Falls Happen More During the Holidays?
Winter in New Jersey means snow, ice, and wet floors, all of which make walking around riskier. Add the holiday rush, and the potential for accidents skyrockets. Here are some of the most common culprits:
- Icy Sidewalks and Driveways
Snow and ice are unavoidable this time of year, but poorly maintained walkways are not. When property owners fail to clear or salt their sidewalks and driveways, they put everyone at risk.
- Slippery Store Floors
Holiday shopping is chaotic. Spilled coffee, tracked-in snow, and over-the-top decorations can create slippery surfaces that stores sometimes neglect to address.
- Poor Lighting
Twinkling holiday lights are beautiful, but they’re no replacement for proper lighting in parking lots and walkways. Dim or uneven lighting makes it hard to spot hazards like black ice or uneven steps.
- Clutter and Obstructions
From holiday displays to packages left on the floor, seasonal clutter turns otherwise safe spaces into accident zones.

What to Do if You Slip and Fall
A slip-and-fall can be overwhelming but acting quickly and carefully afterward can protect your health and your legal rights.
- Assess Your Condition
If you experience severe pain, dizziness, or believe you may have a serious injury (e.g., a broken bone or head injury), try to stay still until medical help arrives. Moving could worsen the injury. - Prioritize Safety
If you’re in an unsafe location – such as a busy walkway or icy area – and you are able to, move carefully to a safer spot to avoid further harm. - Document Everything
Take pictures of the scene, including the hazard that caused your fall, the weather conditions, and any signage (or lack of it). - Report the Incident
Notify the property owner, manager, or store employee right away. Ask for a written report and keep a copy for your records. - Seek Medical Attention
Even if you feel okay, get checked out by a doctor. Some injuries, like concussions or sprains, may not show symptoms immediately. - Collect Witness Information
If anyone saw the fall, ask for their contact information. Their testimony could be crucial later.
Your Legal Rights After a Slip-and-Fall
If you’re injured in a slip-and-fall, you might be entitled to compensation – but proving your case takes more than just saying you fell. Here’s what you need to know:
- The Importance of Documentation
Photos of the hazard, medical records, and incident reports are key pieces of evidence. The more you can show what happened and how it affected you, the stronger your case will be.
- Liability Basics
Property owners have a responsibility to keep their premises safe. If they fail to address hazards like icy sidewalks or wet floors, they could be held liable for your injuries.
- Deadlines Matter
In New Jersey, you usually have two years from the date of the accident to file a personal injury claim. Don’t wait too long – missing this deadline could cost you your chance to recover damages.
