There are many ways that an auto collision can occur, and the circumstances surrounding an accident may dictate the legal recourse available to an injured party. If someone is injured in a car accident in Camden County, he or she may be able to receive compensation with the help and guidance of a car accident attorney. Learning more about the unique aspects of Camden County car accidents can help improve your chances of recovering your damages after a collision.
Common Causes
The most common cause of local car crashes is the inattention of a driver, whether he or she is on their phone, playing with his or her radio, or doing something else in the car. Distracted driving is usually the reason for an auto accident, regardless of whether it is a rear-end incident or running a red light.
Another common cause of motor vehicle collisions is bad weather. If a person is driving through a snowstorm or during heavy rain when the ground gets slick, that could cause an accident. Traffic law violations such as speeding, not stopping at a stop sign, and running a red light are also commonly reported as leading to accidents.

Handling a Claim
Car crash claims in Camden County are subject to comparative negligence laws. That means that an injured plaintiff would receive absolutely no damages if he or she is found to be more than 50 percent responsible for the crash.
If someone is injured in an accident and the other driver is entirely at fault for his or her damages, the other driver would be required to compensate the injured party through their insurance in order to cover his or her medical bills, lost wages, and any other losses that he or she suffered. Alternatively, if both drivers in the case share some blame for the accident, the jury would have to decide who was more at fault for causing the incident.
For example, a claimant who is found to be 51 percent or more at fault for the collision would not be able to recover any compensation for his or her injuries. Otherwise, a person who bears 50 percent responsibility or less would see his or her compensatory award reduced in proportion to his or her assigned percentage of fault.
There are certain factors that could impact liability or fault in one way or another. For instance, who caused the accident, the police report, what law enforcement officers say at the scene of the crash, whether there is property damage, and the type of collision that occurred could all influence a jury’s decision on either driver’s liability.
