Understanding New Jersey’s Dog Bite Laws
Unlike some states that follow a “one-bite rule,” New Jersey law is much more favorable to victims. The state operates under a “strict liability” statute for dog bites, which has significant implications for your case.
New Jersey is a “Strict Liability” State
New Jersey Statute 4:19-16 states that the owner of a dog that bites a person is liable for the damages suffered, regardless of the former viciousness of the dog or the owner’s knowledge of such viciousness.
In simple terms, this means:
- The owner is responsible even if the dog has never been aggressive or bitten anyone before. The “one-bite rule” does not apply in New Jersey cases.
- You do not have to prove the owner was negligent. The act of the dog biting is enough to establish liability against the owner.
This law provides a powerful foundation for your claim, but it is not automatic. You must still prove who owned the dog and that the bite caused your injuries.
The “Lawful Presence” Requirement
The strict liability rule applies as long as the victim was on public property or lawfully on private property when the bite occurred. This includes being an invited guest at someone’s home, a customer in a business, or a mail carrier performing their duties. The law generally does not protect trespassers who are bitten.

Who May Be Held Liable in a Hamilton Dog Bite Claim?
While the dog’s owner is the primary responsible party, liability is not always that simple. An experienced animal attack lawyer in Hamilton will investigate all potential parties who may share responsibility for your injuries. This could include:
- The Dog’s Owner: The person who legally owns the animal.
- The Dog’s “Keeper” or “Harborer”: Someone who was caring for or had control of the dog at the time of the attack, such as a dog walker, pet sitter, or a non-owner family member.
- A Landlord or Property Manager: If a landlord knew they were renting to a tenant with a dangerous dog and did not take reasonable steps to protect other tenants or visitors, they could be held partially liable.
- A Property Owner: If a dangerous dog was allowed to roam on a commercial property, such as an unfenced mechanic shop or retail center, the property owner may have liability.
Identifying all responsible parties is crucial for maximizing the potential compensation you can recover.

What If I Am Blamed for Provoking the Dog?
Insurance companies for dog owners will often try to reduce their liability by arguing that the victim provoked the dog. They may claim you were teasing, hitting, or startling the animal. New Jersey follows a modified comparative negligence rule that might apply to this type of case.
Under this rule, you can still recover damages as long as your share of the fault is not greater than the defendant’s (50% or less). If you are found to be partially at fault, your final compensation award will be reduced by your percentage of fault. Our attorneys are skilled at countering false claims of provocation and protecting you from unfair blame.
What is the Deadline for Filing a Dog Bite Lawsuit in New Jersey?
In New Jersey, the statute of limitations for most personal injury claims, including dog bites, is two years from the date of the incident. Although this may seem like a long time, it is crucial to act promptly. Delaying can result in lost evidence, faded witness memories, and a weakened case. Contacting a lawyer soon after your injury allows them to begin a thorough investigation while the details are still fresh.

Frequently Asked Questions About Dog Bite Claims in Hamilton, NJ
What should I do immediately after a dog bite?
First, create distance between yourself and the animal to prevent further injury. Seek immediate medical attention, even if the wound seems minor, to address the risk of infection. If possible, get the dog owner’s name and contact information. Report the bite to Hamilton Township Animal Control or the local police. Finally, take pictures of your injuries and contact an attorney as soon as you are able.
Does filing a claim mean the dog will be put down?
This is a common concern that prevents many victims from seeking justice. Filing a civil lawsuit for compensation is completely separate from any action animal control might take. Your claim is made against the owner’s insurance policy, not directly against the dog. The decision about the dog’s future is typically handled by local authorities based on the severity of the attack and the dog’s history.
Can I file a claim if the dog belongs to a friend or family member?
Yes. This is a difficult but common situation. It is important to remember that you are not suing your friend or relative personally; you are filing a claim against their homeowner’s or renter’s insurance policy. These policies exist specifically to cover incidents like this. Seeking compensation for your medical bills and other major losses is necessary for your own well-being and is not an attack on your relationship.
