Construction workers are often confronted with risks unique to their industry, including being struck by an object or debris. At many construction sites, workers are handling tools and loose materials at heights, or using equipment to move heavy loads that can fall and injure workers, site visitors, and even pedestrians nearby. These objects can cause devastating injuries, such as paralysis, head trauma, brain injuries and even death. If you or a loved one have suffered harm due to being struck by an object on a construction site, consult with a New Jersey construction accident lawyer to discuss filing an injury claim.

Construction Site Struck by an Object Hazards

  • Hand tools such as hammers or chisels
  • Heavy machinery or large power tools
  • Tool buckets
  • Materials such as bricks, tiles, boards, or wire spools
  • Loose masonry or concrete
  • Paint cans
  • Hardware such as nuts or bolts
  • Crane or forklift loads

While some of these objects may seem more dangerous than others, all of them can cause serious injury when a construction worker is struck by an object.

Risks of Being Struck by an Object

Being struck by an object presents a serious risk for construction workers in all types of environments. According to the Occupational Safety and Health Administration (OSHA), nearly 10 percent of all construction worker fatal injuries are caused by being struck by objects. In 2012, 78 construction workers were fatally injured as a result of being struck by an object at a jobsite.

Pedestrians near construction sites may also be at risk for a construction accident injury if they are walking close to the site, or through an area that is not properly barricaded, and an object or loose piece of debris strikes them. Pedestrians may also gain entry to a construction site after hours if it is not adequately secured which can expose them to numerous risks, including falling objects.

Fault and Damages

Construction companies have a responsibility to maintain a safe environment for their workers and site visitors, and to take all reasonable measures to minimize the risk of a construction site injury. Every person who enters the site, whether they are a worker or a visitor, should be given the necessary Personal Protective Equipment (PPE) and shown how to use it properly. Areas that may be prone to falling objects should have adequate signage and be barricaded to prevent unnecessary entry.

It is also up to the employer to train workers in safety procedures, including securing any loose tools and examining equipment. Safety devices such as debris nets, shore and brace structures, tool guards, toe boards, and catch platforms should always be used when falling objects are a potential risk. Failing to take any of these safety measures is negligent behavior that may result in a serious construction accident.

Construction Accidents

Construction workers who are injured on the job may be eligible for Workers’ Compensation through their employer. If another party’s negligence contributed to a struck by an object injury, however, the victim can also pursue a third party liability claim to obtain compensation. These parties may include general contractors, subcontractors, site owners, equipment manufacturers, architects, or engineers. An experienced lawyer can help you identify the parties responsible for your injuries and hold them accountable for their negligence.
