Cherry Hill Bicycle Accidents and Health Insurance

Request a Free Consultation

In the State of New Jersey, if an individual is on a bicycle and gets into an accident with a vehicle, that person’s own car insurance is most likely going to be the primary insurance company responsible for their medical treatment. Cherry Hill bicycle accidents and health insurance are secondary claims to car insurance. If someone gets into an accident with another vehicle, whether in the vehicle or not, that individual’s car insurance is going to apply. If the person does not have car insurance, then that person’s health insurance would step up.

If the person does not have health insurance, it may be the responsibility of the other driver to pay the medical bills. Contact a distinguished bicycle accident attorney to begin filing damages for the appropriate amount of compensation you deserve.

Filing a Claim Without Insurance

If the person does not have car insurance, then the injured person would file a claim through New Jersey Property Liability Insurance Guaranty Association (“NJPLIGA”), and the state of New Jersey will step in and pay for that person’s medical bills. It would be that person’s own car insurance and, if they do not have that, then it would be the State of New Jersey. Anything that would be outstanding after those two would be the responsibility of the person who hit that individual. Cherry Hill bicycle accidents and health insurance do not typically get involved in the claim filing process because car insurance will take over the damages.

If an individual does not have a car or health insurance, there are two ways that an experienced attorney can help get the medical bills paid. One way is to file a claim through New Jersey Property Liability Insurance Guaranty Association (“NJPLIGA”), and the State of New Jersey. The State of New Jersey specifically has the program in place to pay the medical bills for people who do not have car insurance and are involved in a car accident. Even though someone is on a bicycle and gets hit by a car, it is considered a car accident. NJPLIGA would pay the person’s medical bills and anything outstanding would become a part of a lawsuit against the other driver for payment. In addition to the person’s injuries, pain and suffering, they would also be entitled to payment of any outstanding medical bills that were not covered by the State of New Jersey’s NJPLIGA program. Individuals are able to collect from the other insurance company or the other person.

Benefits of Health Insurance

The only benefit of Cherry Hill bicycle accidents and health insurance would be payment of any co-pays or deductibles that were not covered by car insurance or the State of New Jersey. They could go to your health insurance, but ultimately they would be the responsibility of the other driver. There really is no benefit to have medical insurance if someone is in a car accident or a bicycle accident; a person’s health insurance is secondary and does not really play a major role.

Working with an Attorney

When someone gets into a bicycle accident, it can be confusing to determine who is responsible for the medical bills, e.g., their own car insurance; the other driver’s car insurance; the State of New Jersey or their own health insurance. An experienced injury lawyer can explain who the responsible insurance companies are, set up those claims and make sure that the bills are being paid timely and properly by those insurance companies. The goal is to leave the injured person with no outstanding medical bills. An individual should not be responsible for these medical bills. The individual’s car insurance, the state health insurance, or the other driver should pay these bills, not the injured person.
